1. Acceptance of Terms

By using our website, mobile application, or services (collectively, the “Platform”), you agree to comply with and be bound by these Terms and Conditions and all applicable laws and regulations. If you do not agree with these terms, please do not use our services.

The Platform is owned, registered, and operated by Zutsav Private Limited, incorporated under the Companies Act, 2013, and having its Registered Office at E-012, Assotech, The Nest, Crossing Republic, Ghaziabad, UP-201016, India.

2. Services Offered

Zutsav connects users with verified pandits (priests) for Hindu religious services such as puja, homa/havan, and rituals. We facilitate booking for pandit services, payment, and service confirmation. Additionally, Zutsav operates a mini e-commerce platform for purchasing puja samagri (pooja items) required for these services.

3. Registration

Users

To use our services, users must register by creating an account and providing accurate information, including name, email ID, and phone number. Email verification via OTP is required to complete registration.

Pandits

Pandits can register on Zutsav as service providers. During registration, they must provide details such as name, phone number, email, city, and state. All submissions will be verified by our team within 24–48 hours. Only genuine and respectful pandits will be approved to ensure a safe and trustworthy experience for users. Zutsav reserves the right to reject or remove profiles in case of misconduct, false information, or customer complaints.

4. User Responsibilities

Users are responsible for their account and all activities that occur while signed in or using the Platform. Users agree to:

• Provide accurate information during registration and booking.
• Respect the terms set by Zutsav and its representatives.
• Not post information that is malicious, libelous, false, or inaccurate.
• Not cache any part of the service in proxy servers or allow access by unregistered individuals.
• Acquire and maintain all necessary hardware, software, and communication equipment needed to access the Platform.
• Ensure the accuracy, quality, integrity, legality, reliability, appropriateness, and Intellectual Property Rights (IPR) ownership of all Customer Data. Zutsav is not responsible for the deletion, correction, destruction, damage, loss, or failure to store any Customer Data.
• Not post information that is abusive, threatening, obscene, defamatory, libelous, or racially, sexually, religiously, or otherwise objectionable and offensive.
• Not use the Platform to store, transmit, or receive unacceptable content.
• Use the Platform only for lawful purposes.

5. Booking and Payments

Pandit Services

When booking pandit services on Zutsav, users must discuss all required details with a Zutsav representative, including service requirements and puja samagri. The booking amount may vary based on these requirements. Users must make an advance payment of 80% of the booking amount at the time of booking, with the remaining 20% payable upon service completion. Payments must be made through the provided methods on the Zutsav Platform.

Puja Samagri (Pooja Items)

For puja samagri purchases, users can browse and order items through our e-commerce platform. Product descriptions, images, and prices are provided for guidance but may vary slightly due to market conditions or supplier changes. Users are responsible for verifying item suitability before ordering. Full payment is required at the time of purchase. Delivery times and costs will be communicated at checkout, and users are responsible for providing accurate delivery details. Returns or refunds for puja samagri are subject to our Return Policy, available on the Platform.

6. Time Duration

This Agreement begins when you register on Zutsav or complete a guest checkout and remains in effect for the duration of the Initial Term. Upon expiration, the Agreement will automatically renew for either one year or a period equal to the Initial Term—whichever is shorter—at the then-current applicable rate for the Service.

Upon termination, you will no longer have access to the Services as of the effective termination date, and any outstanding fees or charges incurred up to that date shall remain payable.

7. Data Privacy

For the purposes of this Agreement, the terms Data Controller, Data Processor, Personal Data, Sensitive Personal Data, and Processing refer to the personal and sensitive information provided to Zutsav in relation to the provision of services.

The term Data Protection Law encompasses all applicable data protection legislation, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (SPDI Rules 2011), along with any amendments, updates, re-enactments, or consolidations thereof.

You acknowledge and agree that you act as the Data Controller, and Zutsav operates as a Data Processor. We will:

• Use your data solely in accordance with your instructions as specified in this Agreement and only to the extent necessary to provide the Service.
• Maintain appropriate technical and organizational measures to safeguard the security of your data, protecting it from unauthorized or unlawful access, processing, alteration, accidental loss, destruction, or damage.
• Ensure that personnel with access to your data are reliable and handle it in accordance with applicable data protection laws and this Agreement.

Zutsav may transfer personal data to subcontractors or servers (“Recipients”) located in other countries that ensure adequate levels of data protection. Such transfers will occur only under appropriate agreements incorporating standard contractual clauses or other legally recognized safeguards.

We may process and use your personal data in accordance with our Privacy Policy, which outlines how your information is collected, used, and protected. You can review the full Privacy Policy at Zutsav Privacy Policy.

8. Intellectual Property

You acknowledge and agree that all intellectual property rights associated with the Platform—including but not limited to copyrights, trademarks, trade names, logos, and other proprietary rights—are and shall remain the sole property of Zutsav and its licensors.

Nothing in these Terms shall be construed as granting any license or right to use any intellectual property without the express written permission of Zutsav or the respective rights holder. Any product or company names mentioned on the Platform may be the trademarks of their respective owners. All rights not expressly granted herein are reserved.

9. User Consent to Receive Communications in Electronic Form

By using our services, you (a) consent to receive communications from us electronically at the email address you have provided; and (b) agree that all Terms of Use, agreements, notices, disclosures, and other communications we send electronically satisfy any legal requirement that such communications be in writing. This consent does not affect any rights you may have that cannot be waived by law.

We may use your email address to send updates about the Platform or Service and special promotional offers. You may opt out of receiving promotional emails at any time by updating your account preferences, clicking the “Unsubscribe” link in our emails, or contacting us at info@zutsav.com.

10. Amendments to Terms of Use

We reserve the right to amend these Terms and Conditions at any time and will update them on the Platform accordingly. It is your sole responsibility to periodically review the Terms and Conditions by visiting the Platform to stay informed of any changes. Your continued use of the Platform or Service after any updates constitutes your acceptance of the revised Terms.

We will make reasonable efforts to notify you of significant changes by posting a notice on our homepage and/or sending an email to the address you provided during registration. Therefore, you should keep your contact and profile information current to receive such notifications.

Except as provided in this paragraph, any changes to these Terms or any waiver of our rights will only be effective if made in a written agreement signed by an authorized officer of Zutsav. No waiver or modification made through telephone or email communications shall be considered valid.
